EACC Ordered to Return Evans Kidero's Seized Property Within 72 Hours

The Ethics and Anti-Corruption Commission (EACC) was on Tuesday ordered by the High Court's Anti-Corruption Division to return former Nairobi Governor Evans Kidero's seized property within 72 hours.

The body was also directed by Judge Hedwig Ong'undi to file in court an inventory of the seized property and what has been returned to Kidero.

With the former Governor facing charges of corruption, he argued that search warrants used against him by EACC were illegally obtained, vague and open-ended.

He further maintained that many of the properties EACC detectives were investigating did not form part of the probe.

Kidero sought to quash the warrants asserting that they were meant to “fish for incriminating evidence against him and his family”.

Ong'undi stated that Kidero through his lawyer had satisfied the court that the matters raised were arguable.

The case is to be heard on December 6th for compliance and further direction.

In a notice of motion filed on October 24, Kidero identified 58 properties in Nairobi and Homa Bay which he wanted the EACC barred from investigating.

Kidero argued that he acquired the properties prior to becoming Governor of Nairobi in 2013.

Among the properties were apartments in various parts of Nairobi including Karen, Muthaiga and Gigiri.

EACC estimates the value of Kidero's assets to be around Sh9.1 billion.
