IEBC Chairman Wafula Chebukati and CEO Ezra Chiloba Taken to Court

Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati and CEO Ezra Chiloba have been taken to court regarding the management of the election.

The two were sued by three petitioners who want them barred from conducting the presidential election that was ordered by the Supreme Court.

Shortly after the Court nullified President Uhuru Kenyatta's win in the last polls, the three, Ben Wanasakaami, Kevin Alwang’a and Brian Asin filed the case under a certificate of urgency seeking to stop the Commission from overseeing the upcoming polls.

The voters also sued IEBC Vice-chairperson Consolata Nkatha, Commissioners Prof Abdi Guliye, Roselyn Akombe, Paul Kurgat, Margaret Mwachanya and Boya Molu.

They argued that as state officers, the Commissioners and Chiloba ought to have delivered a credible election but failed to do so.

In the case filed at the High Court, the petitioners stated that the integrity of the officials is in question, therefore, should not oversee the polls.

They urged the court to issue an urgent order restraining the Commissioners or their agents from getting involved with the presidential election pending determination of the case.

“The court should issue conservatory order restraining the commissioners from assuming duties pending the hearing and its determination. The matter is of utmost urgency and should be placed before the duty Judge at the earliest opportune time,” they stated.

The case will now be heard next.

Following the nullification of Kenyatta's win, NASA leaders declared that they would not participate in the repeat election with the current IEBC officials.

They vowed to push for urgent changes in the Commission within the 60 days given by the Court for Kenyans to go the polls.
