DPP Keriako Tobiko Directs Court to Ignore Governor’s Petition

The Director of Public Prosecutions (DPP) on Tuesday requested that a petition filed by Taita-Taveta Governor Granton Samboja seeking to stop an inquiry into claims he forged his academic certificates be dismissed.

In an application set to be heard in January, Mr Tobiko stated that the case was filed in bad faith and was meant to stop his office from discharging its duties.

The DPP further stated that he will independently review the file and evidence gathered before arriving at a decision on whether to charge the Governor or not.

If evidence gathered will be sufficient, Mr Samboja is likely to face charges of uttering false documents, providing false information and making a false statutory declaration.

The DPP, through Mr Fredrick Ashimosi, further stated in the application that he had acted within his constitutional mandate.

Mr Samboja moved to court seeking to stop the Ethics and Anti-Corruption Commission (EACC) from investigating and prosecuting him over his academic papers.

The anti-graft body filed a case questioning his academic papers, indicating they are forgeries after Kenyatta University disowned them.

However, Mr Samboja faults the EACC, alleging that it assumed the role of a prosecutor and judge and had already found him guilty.

He further lamented that the anti-graft body forcibly sought to obtain documentary evidence from him, contrary to the Constitution and maliciously recommended to the DPP that he be charged.

The EACC further alleged that he provided false information on the self-declaration form provided to the IEBC which, in its view, amounts to corruption.
