The document which was drawn and filed by his advocates, Okong'o Omogeni and Co Advocates further stated that anybody interested to be substituted as the petitioner to write to the registrar.

"Take further notice that any person who might have been a petitioner in respect of the said election, may on or before the 23rd of January, 2018 (when the matter is scheduled for hearing) give notice in writing to the Registrar of the intention on the hearing of the application to be substituted as a petitioner," the document further stated.

The former Governor had filed a petition against Governor Mohamud, the Independent Electoral and Boundaries Commission (IEBC) and Marsabit County Returning Officer Arnold Mutwiri Njabani.

Earlier in January,  President Kenyatta stated that he had forwarded the names of the former Governor, former Turkana Senator John Munyes, and Keriako Tobiko - who resigned as Director of Public Prosecutions, to parliament for vetting as his cabinet secretaries.

Following the announcement, there were reports of discord between the Jubilee duo which caused DP William Ruto to state that it was the right of the President to bring together a team he wanted to work with and as such, no one should deny him that.

He warned Jubilee Party members against politicising the issue of cabinet nominees and linking it to 2022 adding that the aim of the government now is to deliver its promises to the Kenyan people.

"Kenyans, more so Jubilee should avoid useless political debates about positions including 2022 and focus single-mindedly on delivering our manifesto voted for by the people while allowing the President the space to perform his constitutional duty to assemble the team for us," he stated.
