Jimmy Wanjigi Humbles Govt After Win in Court

Businessman Jimmy Wanjigi is having the last laugh after the High Court tossed an application by the office of the Director of Public Prosecutions to enhance the businessman’s bail terms.

While still in office, DPP Keriako Tobiko had asked the court to increase the Sh50,000 anticipatory bail that Wanjigi was granted adding that the bail was below the magnitude of the offences that were being probed.

However, on Wednesday, judge Chacha Mwita ruled: “The application by the DPP lacks evidence or any proof to warrant the issuance of the orders sought."

Judge Mwita also pointed out that no statement had been recorded by the businessman who is allied to NASA.

Senior Assistant DPP, Victor Mule, who filed the application for a higher amount, noted it would indicate the seriousness of the offences the businessman allegedly committed.

“Wanjigi should also be stopped from leaving the country without getting permission from police and/or the court, pending completion of the investigations,” Mule added.

The lawyer also asked the court to direct the accused to deposit more documents in court as surety that he will remain in its jurisdiction until investigations are completed.

The businessman is being represented by senior counsel James Orengo (Siaya Senator), Julie Soweto, Otiende Amollo and Harun Ndubi.

Ms Soweto opposed the prosecution's applications terming them insincere since police have never questioned Wanjigi, noting that they have not carried out investigations since raiding his home and destroying property on October 16, 2017.

Soweto, who spoke before Chacha, accused police of mischief and pursuing "untrue claims" that he had firearms.
