Lawyer Exposes Loopholes in Matiangi's Defense Over Miguna Saga

Kenyans.co.ke on Tuesday spoke to lawyer Nelson Havi soon after Interior Cabinet Secretary Fred Matiang'i appeared before Members of Parliament (MPs) to explain why Miguna Miguna was denied entry back to Kenya.

 The Lawyer and Professor Edward Kisiang'ani agreed that the Interior CS had come off as dishonest.

The two commentators particularly objected Dr Matiangi's argument that Miguna was not deported by the government, rather, he was sent away as an undocumented traveller.

Prof. Kisiang'ani described the argument as an outright lie.

"Matiang'i is not honest, he is lying. He is merely using his position as a powerful CS in government to propagate an agenda," he stated.

Mr Havi added: "What we witnessed today is simply a CS puffed up with impunity. Matiang'i has displayed an alarming level of illiteracy on the law."

Prof. Kisiang'ani reiterated the sentiment, explaining that the Constitution was clear on the irrevocability of a person's citizenship.

"Miguna is a Kenyan citizen by birth. Article 16 clearly states that one cannot lose citizenship under any circumstance.

"How is then that Miguna was a Kenyan citizen up until January 30? Why would his citizenship be revoked after swearing in a fellow Kenyan citizen?" the Professor posed.

Mr Havi further tore into Dr Matiangi's defence raising questions over the CS's assertion that he had moved to court challenging the ruling by Justice George Odunga.

"Matiang'i claims not to have been served the summonses he blatantly ignored yet he now says that he and his counterparts have filed an appeal to the ruling.

"If indeed he was never served, then what is he appealing?" Havi questioned.
