DPP Withdraws Defilement Case Against MP Reuben Kiborek

The Office of the Director of Public Prosecutions (ODPP) has withdrawn its defilement case against Mogotio Member of Parliament Reuben Kiborek.

Kiborek's case was withdrawn on Tuesday after Nakuru Chief Magistrate Bildad Ochieng gave a nod to the application by the ODPP.

While making the application, the prosecution argued that there were no witnesses to testify against the United Democratic Alliance (UDA) MP.

The MP was charged after being accused of defiling a 16-year-old in 2018.

Kiborek was arrested after the incident and charged in court over the matter on December 27, 2018.

He was later released on a Ksh300,000 cash bail.

The withdrawal of the case comes after an adjournment in January that was necessitated by the transfer of the investigating officer.

“Not ready to proceed. The investigation officer has been transferred and is yet to hand over the file to the incoming officer,” the Prosecution told the Court at the time.

Kiborek's lawyer Gordon Ogolla had also lamented over the delays in the case given that no witnesses had been presented to testify in court.

"This matter has been in court since 2018 and there is no single day the prosecution has availed witnesses. 

"It is embarrassing to see a file of 2018 in the cause list so if the prosecution is not ready to proceed they should withdraw the case," the lawyer stated.

Kiborek is a first-time lawmaker having contested successfully in the 2022 August polls on a UDA ticket.
