Dismissed Deputy IG Grace Kaindi is Back

The Employment and Labour Relations Court reinstated Grace Kaindi as Deputy Inspector-General of Police until a case she filed challenging her dismissal is determined.

The court on Tuesday stopped the National Police Service Commission (NPSC) from recruiting another candidate to replace her.

The order by Justice Nduma Nderi was given after Kaindi filed a case to sue NPSC and the Attorney General for unlawfully terminating her employment.

Justice Nderi gave the ruling after an advertisement on local dailies proved that the Institution was looking for an officer of the law, who had served for 15 years or less or an official who had served above the rank of Assistant Inspector General.

Kaindi said in her application to the court, that the advertisement of vacancy was illegal and unconstitutional as she was yet to be informed formally of her removal from office.

Kaindi who was forcefully ejected from office about a month ago, attempted to challenge in court her 'forced' retirement but withdrew the first case to explore other avenues of resolution.

She was set to retire in 2018 but her term was cut short by the President who then nominated her to become an envoy.

The President's move sparked reactions from both political and social divides with many claiming that she was kicked out of office unlawfully stifling gains made in women empowerment.

Ms Kaindi's attempts were dampened when she was replaced by Senior Assistant Inspector-General Joel Mboya Kitili in an acting capacity.
