Court Dismisses Petition Against Vihiga Governor Wilberforce Otichilo

The High Court in Kakamega has dismissed a petition challenging the victory of Vihiga Governor Wilber Ottichilo.

The case was filed by voter Hamzah Musuri Kevogo who argued that the Governor’s 82,220 votes were invalid.

He added that  Dr Otichilo had influenced electoral officials to work in his favour and that the entire election was not conducted within the confines of the Constitution and electoral laws.

Justice Ruth Sitati, however, maintained that the governor's election was valid.

“The evidence on record does not support the petitioner’s allegations that the third respondent (Dr Otichilo) was not validly elected.

“Evidence on record shows Governor Otichilo was validly elected. This petition is dismissed as incompetent.

"The petitioner’s case was vexatious and frivolous,” she added.

Dr Otichilo of ODM garnered 82,220 votes, beating his closest challenger, former Governor Moses Akaranga, who got 65,539 votes.

Elsewhere, NARC-Kenya Leader Martha Karua moved back to court after she lost her petition challenging the election of Kirinyaga Governor Anne Waiguru in the August 8 elections.

Ms Karua filed an appeal after Kerugoya High Court Judge Lucy Gitari dismissed her petition terming it incurable, defective and hopeless.

"The former Gichugu MP's case is 'hopeless, defective and incurable'," Justice Gitari noted while delivering the ruling.
