How Police Welcomed Raila to Court

Interesting scenes were witnessed at the Milimani Law Courts in Nairobi as police saluted Opposition leader Raila Odinga who had arrived for National Resistance Movement (NRM) General Miguna Miguna's case on Tuesday.

Kenyans shared the image on social media as some commended the officer for 'recognizing' the NASA leader who took an oath as the 'people's President'.

Others questioned why Odinga could not be arrested at the moment yet the Canada-based lawyer was being charged with swearing him in.

In normal circumstances, police officers normally salute their seniors or high ranking government officials, hence some questioned why he did the same for Odinga. 

During the proceedings, Odinga was in the courtroom alongside businessman Jimi Wanjigi, Vihiga Senator George Khaniri and other opposition leaders.

According to the charge sheet that had been presented earlier at a Kajiado court, Miguna was charged with being present and consenting to the administration of an oath to commit a capital offense namely treason contrary to Section 59 (a) of the penal code.

“On the 30th day of January 2018, at Uhuru Park in Nairobi County, jointly with others not before court, were present and consented to the administration of an oath to Raila Amollo Odinga purporting to bind the said Raila Amollo Odinga to commit a capital offense of treason," the sheet read in part.

Miguna has since been deported to Canada by the Government.

Judge Luka Kimaru had ordered he be produced before the court but police failed to comply with the order.

He had further suspended criminal proceedings against Miguna in any court in Kenya until he was presented before the court.

On Wednesday, his lawyer John Khaminwa confirmed that Miguna had been placed on a KLM flight on Tuesday night and deported to Canada.

"Miguna is headed home. The court ordered he gets released and the Ministry of Interior has even assisted him with a flight ticket home," a tweet from Nexus stated.

Miguna is a holder of a Canadian passport, but the Constitution states that one does not lose citizenship by birth if they acquire another country's citizenship.
