Prosecute Moses Kuria, Raila Urges DPP

Opposition Leader Raila Odinga has urged the Director of Public Prosecutions Keriako Tobiko to arrest and prosecute Gatundu South MP Moses Kuria for perjury and fabricating evidence.

Through a statement issued by Raila's Spokesman Dennis Onyango, the Gatundu South legislator should be tried for obstructing justice, giving false statements and manufacturing information before the International Criminal Court.

He also added that the offenses by Kuria could be tried both at ICC and at a local court.

The International Crimes Act 2008 outlines that a person who willfully attempted to obstruct, pervert or defeat the course of justice of the ICC is guilty of the offense and if convicted can face a prison term of five years.

Odinga refuted claims by Kuria that he participated in the Deputy President William Ruto's accusal by the ICC over crimes against humanity, to settle political differences.

In his statement, Odinga said that Ruto was his close political ally during the 2007-2008 elections when the offenses were supposedly committed.

The Cord Leader stated that involving his name in the ICC matter was a scheme to use Kuria, to conceal the actual people who 'fixed' Ruto at the Hague.

“William Ruto’s prayers are getting answered and his real enemies are giving themselves up without being cajoled or coerced,” Raila said.

Other names included in Moses Kuria's allegations were that of NARC Kenya Leader Martha Karua and Kisumu Senator Professor Anyang' Ny'ong'o.

Both parties came out and denied the claims by the Gatundu South Legislator. Ms Karua gave a 24 hour ultimatum to Kuria for an apology. The MP however asked Karua to take him to court the following day for his comments.

Ny'ong'o also asked Moses Kuria to give exact details of his involvement in Ruto's case.“May Mr Kuria be kind enough to give Kenyans more details regarding my meeting with him together with Raila Amolo Odinga.” said Ny'ong'o.
